Money Laundering Regulations
As an estate agent, Commercial List Ltd must adhere to the Anti Money Laundering Regulations of 2017. Therefore, we are required to obtain and hold identification and proof of address for all our customers. We are also required to establish whether there are any beneficial owners on whose behalf the transaction or activity is taking place, we would request you to identify anyone who you would consider to be a beneficial owner. Where appropriate, we may request the source and destination of funds. Without this information we will be unable to proceed with any work on your behalf.
Please see below a list of acceptable identity documents. We will require sight of all original or certified documents. Subject to your individual circumstances, Commercial List Ltd may liaise with you for further / other documentation.
Documentation
We require one document from List A and One document from List B dated within the past 3 Months.
List A – Identity Documents
- Current signed passport
- Valid UK driving licence
List B – Proof of Address
- Utility bill no more than 3 months old (not a mobile phone bill)
- Bank, building society or credit union statement
- Mortgage statement
- Council tax bill
- Home or motor insurance certificate
- Tenancy agreement
- Solicitor’s letter confirming house purchase / land registration.
- NHS medical card
List C – Property information
- A valid EPC certificate. Since 1st April 2018 The Energy Efficiency Regulations set a minimum requirement that a commercial property must have an EPC of at least E. We can arrange for an EPC to be commissioned if the property does not already have one.
- We require proof of ownership which can be in the form of a copy of the tittle register from Land Registry (£3 charge), copy of the title deeds or confirmation from your solicitor to confirm legal ownership.
- Where we are acting on behalf of a tenant for a leasehold interest, we will require a copy of the lease and any other necessary documents.
Probate
If you are acting as a Representative of an Estate we will require the following;
- Grant of Probate (if a will was left)
- Letter of administration (if no will left)
Individual identity evidence from list A & B for the Personal
- Representative, either executor or administrator.
Limited Company
If you are acting as a Representative of a UK company, we will also require the following;
- A list of Directors and the above identity documents for each Director
- Individual identity evidence from list A and B for all individuals or entities with 25% or more of the shares or voting rights in the company
If you are acting as a Representative of an Offshore Company we will also require the following;
- Articles of Association, Memorandum of Association, Latest Annual Return with details of current company officers, Share
- Certificate(s) showing the Ultimate Beneficial Owners OR
Certificate of Incumbency
- If the shares are owned by another company, repeat steps above for the holding company
- Nominee director declaration and/or general Power of Attorney (if applicable)
- Individual identity evidence from List A & B for all individuals or entities with 25% or more of the shares voting rights in the company.
Trust
If you are acting as a Representative of a Trust we require the following;
- Trust deed
- List of trustees
- List of beneficiaries
- Individual identity evidence from List A & B for all individuals with a vest interest in 25% or more of the capital and/or those who exercise control over the Trust.
